Notarization has evolved from a free service that your bank or credit union probably offered you for free just for being there customer. Today however Florida Notary Publics are becoming Certified Signing Agents / Florida Notary Public and work independently. Once a Notary Public or Notary meets all of the State of Florida requirements to be a Notary Public, the Notary furthers their education to become a Notary Public / Certified Signing Agent. After the Notary studies and passes the Certified Signing Agent test, the Notary has to then pass another background screening. When the Notary successfully passes all testing, they are required to purchase E&O insurance in addition to the Notary Bond that Florida Notary Publics are required to carry. The Notary must retest and pass both the written and the background screening every year to remain a Notary Public/Certified Signing Agent.
Once the Notary Public has become a Certified Signing Agent, the Notary is hired as a 3rd party contractor by banks, credit unions, title companies and lawyers to notarize there closing documents. It’s very common for a Notary Public / Certified Signing Agent to be contracted by your bank to meet you at your bank to perform your next closing.
You’re probably asking yourself why would your bank or credit union hire a Notary as a 3rd party independent contractor Notary Public to notarize their loan documents? The answer is very simple. A Notary Public must be impartial or unbiased to the documents being notarized. Section 117.107(12), of the Florida Statutes, provides that you may not be the notary for a transaction in which you have a financial interest or to which you are a party.
A 3rd party independent contractor Notary Public eliminates a lot of liability for the lender. Banks, credit unions and even hospitals no longer provide notary service due to liability. Hospitals and nursing home nurses won’t even sign as a witness due to liability.
